Question on Life Insurance Policy?

My mother has passed away. She and my father wrote up a life insurance policy in 2007 and then divorced in 2008. He has been paying the monthly payments on the policy. And, now we do not know what happens to that policy since it states the spouse should refund the policy. So, we are wondering what happens next?
