Car accident question, Please help.?
I live in Ontario Canada, Yesterday i was visiting my parents at their house. As i went to leave i was slowly backing into the street to check if there were any cars coming. The snow bank was so high that i could not see over it. As i slowly creped out into the street i stopped to check if any cars were coming down at me or the other direction. I was stopped at the end of the drivway waiting for a second to check again and pull out. All of a sudden a van came out from beside the snow bank and smashed into the back of my car. I have a smashed bumper, the wheel well is broken and cracked opened. The gas cap is bent in and there is roughly $1500+ worth of damage to my car. I had about 1/8th of the length of my car on the street and she was driving extreamly close to the snow banks on the side of the road. She hit the passanger side of the car with her driver side which means she was extreamly close to the side of the road and not close to the middle of the right side where she should have been. People keep telling me it is my fault for not looking to see if there are cars coming but As i can tell from speaking to a few diffrent people I am not at fault because she hit a stopped car. The van that hit me has about $800 worth of damage. We decided not to involve the police and not go through our insurance company because we did not know what to do. I want to know if it was my fault of hers. She was to close to the boulevard and said "I seen you pulling out and i decided not to stop" and after she says "I hit you" But im being told by my parents that it is my fault and that im going to have to pay her.
